The debacle stems from a forgotten signature on a crucial document by the responsible public prosecutor, as admitted by the public prosecutor's office spokesperson to the German Press Agency (dpa). The revelation was initially broken by the state political journal "Rundblick." The oversight led to the withdrawal of the prosecutor's appeal as it was found to contain a formal error.

Although VW was initially successful in contesting the fine in court, the Regional Court's ruling in its favor seems to be final. The opposition CDU faction in the state parliament has labeled the incident a scandal, expressing intentions to discuss the matter further in the legal committee.

It's worth noting that VW was not entirely victorious in its lawsuit against the underlying data protection criticism. While the Regional Court did not make the final decision, the Administrative Court last week only granted VW a partial victory. Two out of the five warnings issued by Lower Saxony's data protection officer in 2023 were lifted, yet the crucial criticism of inadequate data protection information, for which the fine was due, remained unchanged. The verdict is not yet legally binding, and VW can still appeal to the Higher Administrative Court.
